Terms of Use
Effective date: September 25, 2026
These Terms of Use (“Terms”) govern your use of the HomeBinder AI application, related websites, cloud services, and the AI assistant known as Homi (collectively, the “Service”). By downloading, accessing, purchasing, or using the Service, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, and legally capable of entering into a binding agreement to create an independent HomeBinder AI account. If you use the Service for or on behalf of a household or organization, you represent that you have authority to do so.
2. What HomeBinder AI Provides
HomeBinder AI helps households organize and coordinate information and activities relating to the home. Features may include household profiles, members and roles, tasks, routines, events, maintenance, documents, assets, goals, responsibilities, notifications, integrations, and AI-assisted workflows through Homi.
Features may change over time and may differ by device, country, subscription plan, account status, or technical availability.
3. Accounts, Authentication, and Security
You agree to provide accurate information, keep your account secure, and promptly notify us of suspected unauthorized access. Authentication may be provided through services such as Sign in with Apple or Google sign-in. You are responsible for maintaining control of the device and third-party account used to access HomeBinder AI.
You may not transfer, sell, rent, or share access to your account in a way that defeats household access controls or subscription rules.
4. Household Memberships and Invitations
HomeBinder AI may allow an account to participate in a household through the Service's invitation and membership system. Invitations should be sent only to people you are authorized to invite.
Household members may be able to see, create, edit, approve, or act on shared household information according to their access level and the features available. You are responsible for understanding the access you grant to other household members.
Information created collaboratively may form part of the household's shared record. Removing a member does not necessarily remove historical household records that are needed for continuity, auditability, or use by remaining authorized members, subject to applicable law and our Privacy Policy.
5. Your Content and Household Data
“User Content” means information, text, files, documents, photos, audio, household records, instructions, and other materials that you or authorized household members submit to the Service.
You retain ownership of your User Content. You grant us a limited, non-exclusive, worldwide license to host, store, reproduce, transmit, process, transform, and display User Content only as reasonably necessary to operate, secure, improve, and provide the Service, comply with your instructions, and satisfy legal obligations.
You represent that you have the rights and lawful basis necessary to provide User Content to the Service, including information about other household members.
You should maintain independent copies of records that are critical to safety, legal rights, insurance, taxes, ownership, warranties, or emergency response. HomeBinder AI is not your sole archival repository unless a feature expressly states otherwise.
6. Homi and AI-Generated Output
Homi uses artificial-intelligence systems to interpret requests, reason over selected household context, generate summaries or suggestions, and assist with supported workflows.
AI can make mistakes. Homi's responses may be inaccurate, incomplete, ambiguous, or outdated. You are responsible for reviewing important information before relying on it.
Homi does not provide professional legal, medical, financial, tax, insurance, engineering, electrical, plumbing, structural, security, or emergency advice. AI-generated information is for household organization and general informational assistance. Consult an appropriately qualified professional when a decision requires professional judgment.
Do not rely on Homi for emergencies. If there is an immediate threat to life, health, property, or safety, contact the appropriate emergency service or qualified professional.
7. Proposed Actions, Confirmations, and Household Changes
Some features may allow Homi to propose actions that affect household records, such as creating or changing a task, event, routine, responsibility, or other supported item. Where the Service requires confirmation, you are responsible for reviewing the proposed action before approving it.
HomeBinder AI may use audit, idempotency, and state-control mechanisms to reduce duplicate or stale actions, but no software system can eliminate every possible error. You remain responsible for verifying important results.
8. Subscriptions, Free Trials, Billing, and Apple Purchases
Some or all features may require a paid subscription or other in-app purchase.
8.1 App Store billing
When you purchase through Apple's App Store, payment is charged to your Apple Account and billing is handled by Apple. Apple—not HomeBinder AI—controls the payment method, billing processing, and applicable App Store refund process.
8.2 Auto-renewal
If you purchase an auto-renewable subscription, it automatically renews unless canceled in accordance with Apple's subscription rules. The price, billing period, trial terms (if any), and other purchase details are shown in the purchase interface before you subscribe.
8.3 Cancellation
You can manage or cancel an App Store subscription in your Apple Account subscription settings. Deleting the HomeBinder AI app or deleting your HomeBinder AI account does not automatically cancel an App Store subscription.
8.4 Trials and promotional offers
If a free trial or promotional offer is provided, eligibility, duration, conversion to paid service, and pricing are disclosed in the purchase flow. Unless canceled before the applicable renewal deadline, a trial may convert to a paid subscription as disclosed by Apple.
8.5 Price changes
Subscription prices may change in accordance with App Store rules and applicable law. Apple may require notice or consent for certain price increases.
8.6 Restore purchases
Where supported, you may use the app's restore-purchases functionality to restore eligible App Store entitlements associated with your Apple Account.
9. Third-Party Services and Integrations
The Service may interoperate with third-party products such as Apple services, Google services, cloud platforms, authentication providers, calendars, voice infrastructure, subscription-management platforms, or other integrations.
Your use of a third-party service may be subject to that provider's own terms and privacy policy. We are not responsible for third-party services that are outside our control, and we do not guarantee their continued availability or accuracy.
10. Acceptable Use
You may not use the Service to:
- break the law or facilitate unlawful activity;
- violate another person's privacy, intellectual-property rights, contractual rights, or other rights;
- harass, threaten, impersonate, exploit, or abuse another person;
- upload malware, malicious code, or content designed to interfere with the Service;
- probe, scan, defeat, or circumvent authentication, access controls, rate limits, safety controls, or technical restrictions;
- gain unauthorized access to another household or account;
- scrape, reverse engineer, or extract source code except to the extent such restriction is prohibited by applicable law;
- use the Service to build or train a competing service through unauthorized automated extraction;
- submit content you do not have the right to submit;
- use Homi to generate or execute harmful or dangerous instructions in violation of law or another person's rights.
11. License and Intellectual Property
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to use HomeBinder AI on devices you own or control, solely for the Service's intended purposes and subject to applicable App Store usage rules.
HomeBinder AI, Homi, software, interfaces, branding, designs, text, graphics, logos, models, workflows, and other materials provided by us—excluding User Content—are owned by or licensed to us and are protected by intellectual-property laws.
No rights are granted except those expressly stated in these Terms.
12. Availability, Updates, and Changes
We may update, improve, modify, suspend, or discontinue features. We do not guarantee uninterrupted availability. Maintenance, provider outages, network problems, security incidents, platform changes, or circumstances beyond our reasonable control may affect the Service.
Where a material change adversely affects a paid service, we will comply with applicable consumer-protection and App Store requirements.
13. Suspension, Termination, and Account Deletion
You may stop using the Service at any time. Where account creation is supported, the app provides or will provide an account-deletion mechanism consistent with applicable App Store requirements.
We may suspend or terminate access if you materially breach these Terms, create security or legal risk, abuse the Service, fail to pay amounts properly due, or where suspension is reasonably necessary to protect users or the Service.
Termination does not automatically cancel an App Store subscription. Manage App Store subscriptions through Apple.
Sections that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, dispute terms, and accrued rights—will survive.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE SERVICE, HOMI, AI OUTPUT, CONNECTED SERVICES, HOUSEHOLD DATA, REMINDERS, NOTIFICATIONS, OR AUTOMATIONS WILL ALWAYS BE ACCURATE, COMPLETE, TIMELY, SECURE, OR ERROR-FREE.
Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you. Nothing in these Terms limits rights that cannot lawfully be waived.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMEBINDER AI, ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.
This limitation does not apply where prohibited by law, including where liability cannot lawfully be excluded or limited.
16. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless HomeBinder AI from third-party claims, liabilities, losses, and reasonable costs arising from your unlawful use of the Service, your violation of these Terms, or User Content you submit in violation of another person's rights. This provision does not apply to the extent prohibited by consumer-protection law.
17. Governing Law and Disputes
These Terms are governed by the laws of Kenya, without regard to conflict-of-law rules, except where the mandatory laws of your place of residence apply.
Subject to mandatory consumer rights, courts of competent jurisdiction in Kenya will have jurisdiction over disputes relating to these Terms.
If you are a consumer in a jurisdiction that gives you a mandatory right to bring claims in your home jurisdiction, this section does not take that right away.
18. Additional Terms for Apple's App Store
If you obtain HomeBinder AI through Apple's App Store, the following terms apply in addition to the rest of these Terms:
18.1 Acknowledgment
These Terms are between you and HomeBinder AI, not Apple. We, not Apple, are solely responsible for HomeBinder AI and its content, except as otherwise stated by applicable law.
18.2 Scope of license
Your license is limited to a non-transferable license to use HomeBinder AI on Apple-branded products that you own or control and as permitted by the Apple Media Services Usage Rules. The app may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing where Apple permits it.
18.3 Maintenance and support
We are solely responsible for providing maintenance and support for HomeBinder AI as specified in these Terms or required by applicable law. Apple has no obligation to furnish maintenance or support services for the app.
18.4 Warranty
To the extent a warranty applies and HomeBinder AI fails to conform to it, you may notify Apple and Apple may refund the purchase price, if any, for the app as provided by Apple's policies. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to HomeBinder AI. Other claims attributable to a failure to conform to a warranty are our responsibility to the extent required by law.
18.5 Product claims
We, not Apple, are responsible for addressing claims relating to HomeBinder AI or your possession and use of it, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer-protection or privacy law, to the extent required by applicable law.
18.6 Intellectual-property claims
If a third party claims that HomeBinder AI or your possession and use of it infringes that party's intellectual-property rights, we—not Apple—are responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by these Terms and applicable law.
18.7 Legal compliance
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on a U.S. Government list of prohibited or restricted parties.

18.9 Third-party terms
You must comply with applicable third-party agreements when using HomeBinder AI, including the terms governing your wireless-data service, Apple Account, and any connected service you authorize.
18.10 Apple as third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your license to the iOS application. Upon your acceptance of these Terms, Apple will have the right to enforce the applicable App Store provisions against you as a third-party beneficiary.
18.11 Apple Standard EULA
To the extent these Terms do not provide terms required for an App Store licensed application, Apple's then-current Standard Licensed Application End User License Agreement applies as required by the App Store. If a mandatory Apple term conflicts with these Terms, the mandatory Apple term controls for the App Store license.
19. General Terms
Entire agreement. These Terms, the Privacy Policy, and any purchase terms presented to you form the agreement relating to the Service.
Severability. If any provision is held unenforceable, the remaining provisions remain in effect to the extent permitted by law.
No waiver. Failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, reorganization, financing, or sale of the Service or substantially all related assets, subject to applicable law.
Changes. We may update these Terms. If a change is material, we will provide notice when required by law. Continued use after the effective date of revised Terms constitutes acceptance where permitted by law.
